Trial resumes for man charged in Smart abduction

SALT LAKE CITY (AP) — Defense attorneys for the man accused of abducting Elizabeth Smart are not disputing the facts in the case, but they’re trying to show at Brian David Mitchell’s trial that he’s mentally ill and can’t be held responsible.

Smart was 14 when she was abducted from her home at knifepoint on June 5, 2002. She was recovered nine months later — on March 12, 2003 — disguised in wig and sunglasses and walking a suburban Salt Lake City street with Mitchell.

Now 23, Smart has testified during Mitchell’s ongoing trial that she was forced to enter a polygamous marriage with Mitchell, endured near daily rapes, was forced to use drugs and alcohol, and was taken to California against her will about four months.

If convicted, the 57-year-old former street preacher could spend the rest of his life in prison.

After a break for the Thanksgiving holiday, the federal trial was resuming Monday for Mitchell, charged in U.S. District Court with the kidnapping and unlawful transportation of a minor across state lines for the purposes of illegal sexual activity.

As the trial moves into its fourth week, the defense is expected to call on psychiatric evaluators to testify about Mitchell’s competency.

Included on the list of defense witnesses is Dr. Richart DeMier, a forensic psychologist from a federal prison facility who was court-ordered to evaluate Mitchell in 2009, DeMier diagnosed Mitchell as paranoid schizophrenic and said he was not competent to stand trial.

DeMier’s findings contradict those of Dr. Michael Welner, New York City forensic psychologist hired by prosecutors to conduct his own evaluation. Welner diagnosed Mitchell with an anti-social personality disorder, psychopathy, alcohol abuse and said he is “malingering” — faking or exaggerating an illness to avoid prosecution.

Both evaluators were also on the stand during a 10-day competency hearing held in 2009.

DeMier said then he had based his conclusion on Mitchell’s belief that “he is divinely ordained to fulfill a special role at the end of the world, putting himself on par with Jesus or God.”

In March, U.S. District Judge Dale Kimball ruled Mitchell competent for trial.

Also expected on the witness stand is Utah psychologist Dr. Stephen Golding who found Mitchell incompetent for trial in a parallel state case. Golding has said Mitchell has “referential thinking” and ascribes special meaning to ordinary experiences.

During the 2009 competency hearing, Golding testified that religious-based delusions left Mitchell believing he was being pressured or commanded to do certain things. The directives came through emotionally distressing revelations, Golding said.

“Mr. Mitchell’s ego, his self, was constantly warring with what he thought he needed to do,” Golding explained last year. “Over time it developed into a pretty frank delusional disorder.”

Smart has testifed that she never believed Mitchell’s religious beliefs were sincere and that he used religion to manipulate others. That included Smart and Wanda Eileen Barzee, Mitchell’s now-estragned wife, who pleaded guilty to federal charges in the case last year after more than year of court-ordered treatment with anti-psychotic medications.

Last week, a tearful 65-year-old Barzee, who is serving a 15-year prison term, testified that she had once believed that her husband was being directed by God. In hindsight, Barzee said, she sees it was a ruse.

“He was a great deceiver,” she said.

Shopping for Home Electronics the Smart Way

When it comes time to go shopping for any new home electronics product there are innumerable options. Of course when given a lot of choices, the decision as to which to buy can be pretty confounding. Thinking through how the device will be used will help identify the features that an individual really wants and assures they avoid paying for things they won’t ever use. But even then, the number of choices can still be a bit overwhelming, so what other information can help in making the right selection?

Information on the opinions of others can be crucial; both outside experts and current customers. Experts are skilled at assessing home electronics products and know the market while current customers are living the experience.

What do the experts say

The opinion and ratings of “experts” is a starting point. When searching online there are innumerable sites that provide ratings, opinions, and reviews of home electronics products. Unfortunately, to gain these pearls of wisdom sometimes requires a fee. Certainly there are also sites that offer the information for no fee. However, it is sometimes questionable how unbiased the ratings might be as many of the sites posting this information may also be selling similar products. This does not always translate into biased information but consumers need to be aware of the potential.

The credibility of disinterested experts

Certainly some sites offer valuable information. Consumer Reports as an example is independent of any advertisers in order to avoid any bias, making their ratings and reviews of specific products credible. Sites and publications that have no vested interest in making a sale may be an option for finding unbiased information.

Additional information from experts who also market

However, some marketers online do have a strong background in the topic area of certain home electronics products and thus can provide great information to assist consumers in making a choice. In addition, such marketer run sites often allow users to ask questions and interact through blogs and forums providing even more useful information. Consumers merely need to assess the information they read. Articles and reviews that merely provide information, a description of features, and so forth can be useful in making a selection, but information that appears to be a hard sell is probably no more than that.

What do current customers say

Even if the opinions of experts all seem to point toward a particular product and the features of the item match the individuals needs, it can be important to find out how the device performs; thus the opinions of current users can play an important role when shopping.

Real world feedback from forums

Online forums offer consumers the opportunity to provide and review feedback which is unbiased. Even in an open forum type setting however some online marketers will post their feedback. For some it is just another opportunity to sway buyers without their being aware while others offer expert advice. Thus, consumers need to evaluate the reliability of what they read, realizing that both consumers and some internet marketers may be posting there.

So how is a consumer to decide what is reliable feedback, and what is not, in a forum type of situation? Certainly getting to know the participants in a forum can help. As in any setting, gaining a respect for the knowledge of other participants can help in trusting their opinions. Another possibility is to ignore single posts and make note of the trends. Any product can have a dissatisfied customer or an eager internet marketer who makes a post in order to sway readers. However, if there are numerous people posting similar information, whether they are consumers or marketers, it would seem important to heed their messages.

The credible, but limited information from formal surveys

Formal market surveys are another tool that can be helpful in discovering what current customers really think about a particular company or service. They generally don’t provide feedback regarding specific products but do provide a good indication about how current customers feel about the products or services of a particular company.

One example, JD Power, is a company that has been a leader in measuring customer satisfaction in a wide variety of industries for many years. Individuals can go to jdpower.com look at the results of their most recent surveys in areas such as telecommunications providers, home electronics manufacturers, and so forth. Looking at ratings for customer service, reliability, and similar items can certainly shed some light on how current customers view the performance of the products and services of these companies.

Although shopping in the world of home electronics can be a daunting task obtaining information through reviews, ratings, informational articles, and the opinions of both experts and current customers can provide guidance. With a bit of research and a discerning eye, consumers can find the information they need online to make the best choice.

Smart design explains and unifies data from across the spectrum of scientific fields

What we see in biology and Cosmology is a fine-tuning to ensure privacy. ID argues that the level of information, this fine tuning is exactly the kind of information we understand viewing experience, has intelligence. This argument design is not based on the unexplained "mysteries" in science. Instead, it relies on the find in nature, the type of complexity that we know originates from intelligence. It is a positive argument.

To summarize this argument, some of the most important discoveries in biology from the 20th century - which ID adheres without reserve - discovery found that life is based on:

  • A large quantity of information encoded in a biochemical; language
  • A computer system codes and commands which deals with the information to produce...
  • Multi-machine systems and molecular machines.

Where, in our experience, things like language, information, programming code or machines come from? They are a known source: intelligence.As Stephen Meyer wrote in signature in the cell:

Experience shows that substantial quantities of specified complexity or information (including codes and languages) are invariably a source smart - spirit or agent personal. ..."For the discovery of the digital information specified in the offer DNA molecule of solid reasons to infer that intelligence played a role in the origin of the DNA when effect whenever we find specified information and known history causal how this information was raised, we still find it follows an intelligent source".(p. 341, 347)

BioLogos goes on to say 'BioLogos rejects the' God gap ' reasoning."However, Meyer cited above reasoning is most certainly not"gaps"- style thinking.It is based on what we know about the powers of causation of intelligent agents and positive signs of finding intelligent organization in natural systems.Unfortunately, BioLogos misframes ID as a negative criticism merely natural processes.

Reality is that the ID uses science to method its scientific method revendications.La is often described as a four step process involving hypothesis, comments, experiences and conclusion.ID begins by observing that the intelligent agents produce complex specified information (CSI) .Conception theorists hypothesize that if a natural object has been designed, it will contain high levels of CSI.Scientifiques then perform experimental natural to determine if they contain complex information objects tests and spécifiées.Une form of CSI is irreducible complexity, which can be tested for by reverse-engineering experimentally to experience biological structures genetic knockout to determine if they have all their parts fonctionner.lorsque experimental work uncovers the irreducible complexity in biology, researchers conclude that these structures were designed.

Using these methods, ID explains and unifies a wide variety of data from a number of scientific fields, including:

  • Biochemistry, where ID encourages scientists to recognize and understand the origin of the information specified in the protein and DNA; and complex
  • Genetics, where ID encourages scientists trying to function for the so-called "junk" DNA;
  • Systematics, where ID encourages scientists to understand whether the similarities between living species, including examples of genetics extreme "convergence," are best explained by ID instead of Darwinism.
  • Cell biology, where ID encourages scientists to display the cell as built from "structures designed instead of accidental by-product of the Darwinian evolution" which allows scientists to better understand the molecular machines;
  • Biology of systems where ID encourages biologists consider various biological systems as integrated components of large systems that are designed to work together in top-down manner, coordinated;
  • Animal biology where ID encourages scientists trying to function for the structures would have been "remnant";
  • Bio-informatics, where ID encourages scientists to find new information and functional language incorporated into the genetic codes, but also other codes in biology; layers
  • Theory of information, where ID encourages scientists to understand where intelligent causes are higher than natural causes in the production of certain types of information;
  • Paleontology where ID encourages scientists to understand how the nature irreducibly complex biological systems can predict with change and stasis in the history of life;
  • Physics and Cosmology, where ID encourages researchers to explore and discover instances of refinement of the laws of physics, that allow to the existence of advanced forms of life.
ID is not simply a negative argument against Darwinian evolution or causes another matériau.Encore once, if you agree or disagree with the ID, you cannot deny that make a positive argument ID proponents.

By ID calling a "non-scientific" explanation, the BioLogos taxonomy is not only inexacte.Il moves be allegedly descriptive expressly be partisane.Ils have the right to have some perspective they wish, but it seems that they cannot describe same ID without leading the reader with discussion biaisée.De even, Mr. Benson innocently asked "what better riding describes your point of view and why?," but who wants to agree with descriptions that are then labelled "scientists"? in law, it is a question of leadership.

No mistake: If you are looking for dry objective facts on ID, you won't find them in this BioLogos description.

Institute for discovery, which certainly has its own prejudices and the prospect has created a Web site which deals with the different points of view on this question.Pour a different perspective on the theistic evolution, visit faith and Evolution.
